ChurchNET Terms and Conditions

These Terms and Conditions (the “Terms”) govern your use of the ChurchNET platform, including our mobile applications, websites, and our SMS and text messaging program. Please read them carefully.

1. Acceptance of These Terms

ChurchNET (“ChurchNET,” “we,” “us,” or “our”) provides church management software to congregations and to the members of those congregations. By creating an account, using the ChurchNET applications or websites, or receiving text messages from a congregation that uses ChurchNET, you agree to these Terms. If you do not agree, please do not use the service.

ChurchNET is used by two kinds of users. A Church is the congregation or organization that subscribes to ChurchNET. A Member is an individual who participates in that congregation and uses ChurchNET through it. Some sections below apply only to Churches, and some apply only to Members.

2. SMS and Text Messaging Terms

This section is the complete terms and conditions for the ChurchNET text messaging program. It applies to every text message sent through the ChurchNET platform.

a. Program Description

ChurchNET operates a text messaging platform on behalf of the congregations that subscribe to it. Each congregation is assigned its own dedicated toll-free number, and every message you receive is sent from the number belonging to the congregation you are affiliated with. Messages relate to the life and activities of that congregation — they are not marketing or promotional messages from ChurchNET, and ChurchNET does not use these numbers to advertise its own products to your members.

b. How You Opt In

You are added to a congregation’s text messaging program only when you provide your mobile number to that congregation and agree to receive text messages from it. This typically happens when you join the congregation, when you create or update your profile in the ChurchNET app, when you register for an event, or when you sign up to serve as a volunteer.

Consent to receive text messages is not a condition of purchasing any goods or services, and it is not required in order to attend, participate in, or be listed in the directory of a congregation. You may decline at any time.

c. Types of Messages You May Receive

Depending on how you participate in your congregation, you may receive:

  • Announcements and updates sent by your congregation’s leadership
  • Prayer request notifications, if you are a designated prayer recipient
  • Event registration confirmations and event reminders
  • Volunteer schedule reminders and requests for a substitute
  • Notifications that a service or stream is starting
  • Account and security messages, such as confirming a change to your contact information
  • Follow-up messages after a visit, if you are a guest

d. Message Frequency

Message frequency varies. The number of messages you receive depends on your congregation’s activity and on how you participate in it — for example, volunteers and prayer recipients generally receive more messages than other members.

e. Cost

Message and data rates may apply. ChurchNET does not charge Members any fee to receive text messages, but your mobile carrier may charge you for messages according to your plan. Please contact your carrier if you have questions about your plan.

f. How to Opt Out

You can cancel at any time. Reply STOP to any text message you receive from your congregation. You will receive a single message confirming that you have been unsubscribed, and after that you will not receive any further text messages from that number unless you opt back in.

Because each congregation uses its own number, replying STOP unsubscribes you from that congregation. If you are affiliated with more than one congregation that uses ChurchNET, reply STOP to each one you wish to leave. You may also opt out by updating your notification preferences in the ChurchNET app, by asking your congregation’s administrator to remove your number, or by emailing us at support@churchnet.app.

If you opt out of text messages, you may still receive email or in-app notifications, and you remain a member of your congregation’s directory unless you ask to be removed.

g. How to Get Help

Reply HELP to any message you receive for assistance, or contact us directly at support@churchnet.app. We will respond with information about the program and how to reach support.

h. Carriers and Delivery

Carriers are not liable for delayed or undelivered messages. ChurchNET does not guarantee that any message will be delivered, and you should not rely on text messaging for emergencies or time-critical needs. Delivery depends on your carrier, your device, and network conditions outside our control.

i. Eligibility

You must be the account holder of, or have permission from the account holder of, the mobile number you provide, and you must be at least 13 years old to enroll in text messaging on your own behalf. A parent or guardian must consent on behalf of a minor.

j. Changing Your Mobile Number

If you change or give up your mobile number, please update your profile or notify your congregation promptly so that messages intended for you are not sent to someone else.

k. Privacy

Mobile information collected for text messaging is handled as described in our Privacy Policy. No mobile information will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Phone numbers are shared only with the messaging providers that deliver messages on our behalf, and only for that purpose.

3. The ChurchNET Service

ChurchNET provides tools for congregations including a member directory, events and registration, volunteer scheduling, prayer requests, attendance, giving, streaming, and communication by email, text, and push notification. We may add, change, or discontinue features over time. We will give Churches reasonable notice before removing a feature they materially rely on.

4. Accounts and Eligibility

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly at support@churchnet.app if you believe your account has been used without your permission. A Church is responsible for the administrators it designates and for the permissions it grants them.

5. Subscriptions, Billing, and Cancellation

This section applies to Churches that subscribe to ChurchNET.

  • Subscriptions are billed monthly or annually in advance, at the plan and price agreed at signup, and renew automatically for successive terms until cancelled.
  • There are no long-term contracts. You may cancel at any time, and you may move between monthly and annual billing at any time.
  • New churches may be offered a 90-day pilot. No subscription fee is charged during the pilot, and you may end it at any time without obligation.
  • Cancellation takes effect at the end of your current billing period. Fees already paid are non-refundable except where required by law or where we have agreed otherwise in writing.
  • We may change our prices. We will give at least 30 days notice before a change applies to your renewal, and you may cancel before it takes effect.
  • If a payment fails, we may suspend access after notifying you and giving you a reasonable opportunity to correct it.

Payments are processed by our payment processor. We do not store full payment card numbers.

6. Acceptable Use

You agree not to use ChurchNET to:

  • Send unsolicited commercial messages, marketing on behalf of unrelated third parties, or any message to a person who has not consented or who has opted out
  • Send content that is unlawful, harassing, defamatory, deceptive, hateful, sexually explicit, or that promotes violence or illegal activity
  • Send content prohibited by mobile carriers, including messages relating to cannabis, illegal substances, firearms, gambling, high-risk lending, or get-rich-quick schemes
  • Upload malicious code, attempt to gain unauthorized access to the service or to another congregation’s data, or interfere with the operation of the platform
  • Use another person’s information, or the ChurchNET directory, for any purpose other than the ministry of the congregation — including selling or distributing member contact information
  • Violate any applicable law, including telemarketing and messaging regulations

A Church is responsible for the content of the messages it sends and for obtaining consent from the people it sends them to. We may suspend or remove content or accounts that violate this section, and we may be required to do so by our carriers or providers.

7. Your Data and Ownership

A Church owns the data it puts into ChurchNET, including its member directory, events, giving records, and message history. We do not sell that data, and we do not use it to advertise to your members. We process it in order to operate the service for you, as described in our Privacy Policy.

On request, and for a reasonable period after cancellation, we will provide a Church with an export of its data. After that period we may delete it.

8. Third-Party Services

ChurchNET relies on third parties to operate, including providers for messaging and voice, payments, cloud hosting, and email delivery. Their handling of data is governed by their own terms. We are not responsible for the acts or omissions of these providers beyond our own reasonable care in selecting and configuring them.

9. Intellectual Property

ChurchNET and its software, design, and trademarks remain our property. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription. You may not copy, reverse engineer, resell, or create derivative works from the platform without our written permission.

10. Termination

You may stop using ChurchNET at any time. We may suspend or terminate access if you materially breach these Terms, if required by law or by our providers, or if your account creates a security or compliance risk. Where practical we will give notice and an opportunity to cure first.

11. Disclaimer of Warranties

ChurchNET is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that every message will be delivered.

12. Limitation of Liability

To the fullest extent permitted by law, ChurchNET will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability arising out of or relating to these Terms will not exceed the amount you paid us in the twelve months before the claim arose.

13. Indemnification

A Church agrees to indemnify and hold ChurchNET harmless from claims arising out of the content it sends, the consent it obtained or failed to obtain from its recipients, and its use of the service in violation of these Terms or applicable law.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and change the effective date above. If a change materially affects your rights, we will make reasonable efforts to notify you. Continued use after a change takes effect means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Tennessee, and you consent to their jurisdiction.
